These terms apply when you visit or buy from the BrickClava website (“the site”). By placing an order, you agree to them. They sit alongside your legal rights as a consumer, which they don’t limit.
1. Who we are
BrickClava (“we”, “us”) sells novelty face masks and related items online. You can contact us at any time through the Contact page on this site.
2. Orders
- When you place an order, you’re making an offer to buy. We accept it when we send you an order confirmation email, or when we ship the goods.
- We may decline or cancel an order, for example if a product is out of stock, there’s a pricing error, we suspect fraud, or we can’t deliver to your address. If we cancel an order you’ve paid for, we’ll refund you in full.
- Please check your details before you pay. Contact us quickly if you need to correct something, and we’ll try to fix it before dispatch.
3. Prices and payment
- Prices are shown in the currency selected on the site and include VAT where it applies. Delivery charges, where there are any, are shown before you pay.
- Bundle savings are applied automatically in your bag and at checkout. The price you see at checkout is the price you pay.
- Payment is taken at checkout through our payment providers. We never see or store your full card details.
- We may correct obvious pricing mistakes. If a mistake is made, you’ll have the choice to confirm the order at the correct price or cancel it for a full refund.
4. Products
- We do our best to show colours, designs and sizes accurately, but screens vary, so slight differences are possible.
- Our masks are novelty and fashion items. They are not protective equipment, not medical products and not toys. Don’t wear them in a way that blocks your vision or breathing, and don’t let young children wear them unsupervised.
- Follow the care instructions on the product or its packaging. Product images may show accessories such as goggles that are not included; the product description states what comes in the box.
5. Delivery
- Delivery times and costs are shown at checkout. Times are estimates and not guarantees, and they can be affected by customs, carriers and weather.
- Responsibility for the goods passes to you when you or someone you nominate takes delivery.
- You may be liable for customs charges or taxes in some destinations. We’ll tell you at checkout if any apply.
6. Returns, refunds and faulty goods
Our Returns and Refund Policy forms part of these terms. It explains your right to change your mind and what we do for faulty or wrong items. Nothing in these terms limits your statutory rights under Irish and EU consumer law, including your right to a remedy for faulty goods.
7. Our intellectual property
All content on the site, including text, designs, logos and images, belongs to us or our licensors and is protected by law. You may not copy, reproduce or use it for commercial purposes without our written permission.
BrickClava is an independent business. We are not affiliated with, endorsed by or sponsored by any toy company, ski brand or other third-party brand. Any third-party names mentioned belong to their owners.
8. Using the site
You agree not to use the site unlawfully, interfere with its operation, try to gain unauthorised access, or submit false information. We may suspend or restrict access if you break these rules.
9. Reviews and content you send us
If you send us reviews, photos or messages, you confirm they are honest and your own, and you give us permission to use them on the site and in our marketing. We may remove content that is false, offensive or unlawful.
10. Privacy
We collect and use your personal data as described in our Privacy Policy. By using the site, you acknowledge it.
11. Our liability
We’re responsible for loss or damage you suffer that’s a foreseeable result of our breaking these terms or our negligence. We don’t exclude or limit liability for death or personal injury caused by our negligence, for fraud, or for anything that cannot be limited by law.
Otherwise, we aren’t liable for loss that wasn’t foreseeable, for loss of profit or business (since you’re buying as a consumer), or for delays or failures caused by events beyond our reasonable control, such as strikes, carrier disruption, severe weather or supplier issues.
12. Changes to these terms
We may update these terms from time to time. The version in force when you place your order applies to that order.
13. Governing law and disputes
These terms are governed by the laws of Ireland, and the courts of Ireland have jurisdiction, but if you’re a consumer living elsewhere in the EU, you keep the protection of the mandatory laws of your own country and may bring a claim in your local courts.
If you have a complaint, contact us first through the Contact page and we’ll try to resolve it. You can also use the EU’s Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
14. General
If any part of these terms is found unenforceable, the rest still applies. If we don’t enforce a right straight away, we haven’t given it up. These terms, together with our Returns and Refund Policy and Privacy Policy, are the entire agreement between us about your purchase.
